The Directive Principles of State Policy (DPSP) are enshrined in Part IV (Articles 36 to 51) of the Constitution of India. Dr. B.R. Ambedkar described them as a “novel feature” of the Constitution. The concept was borrowed from the Irish Constitution of 1937. They are guidelines to the central and state governments to be kept in mind while framing laws and policies, embodying the concept of a welfare state and seeking to establish social and economic democracy in India.

A crucial feature is that DPSPs are non-justiciable. Article 37 states that the provisions of Part IV shall not be enforceable by any court, but the principles are nevertheless “fundamental in the governance of the country,” and it is the duty of the State to apply them in making laws. Thus citizens cannot approach a court if a Directive is violated, yet they carry great moral and political value as a yardstick of a government’s performance.

Key amendments: The 42nd Amendment (1976) added Article 39(f), 39A (free legal aid), 43A (workers’ participation) and 48A (environment). The 44th Amendment (1978) added 38(2) to minimise income inequality. The 86th Amendment (2002) reworked Article 45 and made elementary education a Fundamental Right (21A). The 97th Amendment (2011) added 43B for cooperative societies.

Rights vs DPSP: In Champakam Dorairajan (1951) Fundamental Rights prevailed over DPSPs; Kesavananda Bharati (1973) gave the Basic Structure Doctrine; and the landmark Minerva Mills (1980) held the Constitution rests on the balance between Fundamental Rights and Directive Principles.

அரசு கொள்கையின் வழிகாட்டு நெறிமுறைகள் (DPSP) இந்திய அரசியலமைப்பின் பகுதி IV (சரத்துகள் 36 முதல் 51 வரை) ல் இடம்பெற்றுள்ளன. டாக்டர் பி.ஆர். அம்பேத்கர் இவற்றை அரசியலமைப்பின் “புதுமையான அம்சம்” என வர்ணித்தார். இக்கருத்து 1937 அயர்லாந்து அரசியலமைப்பிலிருந்து எடுக்கப்பட்டது. இவை நலன்புரி அரசு என்ற கருத்தை உள்ளடக்கி, சமூக-பொருளாதார ஜனநாயகத்தை நிறுவ முயல்கின்றன.

DPSP-களின் முக்கிய அம்சம் அவை நீதிமன்றத்தில் வழக்குத் தொடர இயலாதவை என்பதாகும். சரத்து 37 படி பகுதி IV ன் விதிகளை நீதிமன்றம் அமல்படுத்த இயலாது; ஆயினும் இவை “நாட்டின் ஆட்சிக்கு அடிப்படையானவை” மற்றும் சட்டங்களை உருவாக்கும்போது இவற்றைப் பயன்படுத்துவது அரசின் கடமையாகும்.
