The Anti-Defection Law is contained in the Tenth Schedule of the Constitution of India.
It was inserted by the 52nd Constitutional Amendment Act, 1985, during the Prime Ministership of Rajiv Gandhi.
The 52nd Amendment also amended Articles 101, 102, 190 and 191 relating to vacation and disqualification of seats.
A member is disqualified if he voluntarily gives up membership of his political party.
A member is also disqualified if he votes or abstains from voting contrary to the party whip, without prior permission, and the party does not condone it within 15 days.
An independent member is disqualified if he joins any political party after the election.
A nominated member is disqualified if he joins a political party after six months from taking his seat.
The 91st Amendment Act, 2003 deleted the “split” exception (one-third), leaving MERGER as the only surviving exception.
Under Paragraph 4, a merger is valid only if not less than two-thirds of the members of the legislature party agree to it.
The Speaker or Chairman who voluntarily gives up party membership on election to that office is exempt from disqualification.
The question of disqualification is decided by the Chairman (Rajya Sabha / Legislative Council) or the Speaker (Lok Sabha / Legislative Assembly).
In Kihoto Hollohan v. Zachillhu (1992), the Supreme Court upheld the Tenth Schedule but struck down Paragraph 7, which had barred judicial review.
The 91st Amendment inserted Articles 75(1B) and 164(1B) — a disqualified defector cannot be appointed a Minister until re-elected or till his term ends.
Article 361B (inserted by the 91st Amendment) bars a disqualified member from holding any remunerative political post.
The 91st Amendment also capped the Council of Ministers at 15% of the House — Article 75(1A) for the Union and Article 164(1A) for States (minimum 12 in a State).
Why the law was needed
Indian politics after the fourth general election of 1967 was marked by extraordinary instability. Legislators changed parties so freely that between 1967 and 1971 dozens of state governments were made and unmade purely through floor-crossing. The phrase “Aya Ram, Gaya Ram” entered the political vocabulary after a Haryana MLA switched parties three times within a fortnight. Successive committees — including the Y. B. Chavan Committee on Defections (1969) — recommended legal remedies, but no law was passed for nearly two decades.
The breakthrough came in 1985. The Constitution (Fifty-second Amendment) Act, 1985, added a new Tenth Schedule to the Constitution and simultaneously amended Articles 101, 102, 190 and 191. Article 102(2) and Article 191(2) now state that a member of Parliament or of a State Legislature shall be disqualified if he is so disqualified under the Tenth Schedule. The law came into force on 1 March 1985.
Grounds of disqualification
The Tenth Schedule classifies legislators into three categories and prescribes different tests for each.
Members of political parties. Such a member is disqualified on two grounds. First, if he voluntarily gives up his membership of the party. The Supreme Court has clarified that “voluntarily giving up” is wider than formal resignation — conduct such as publicly campaigning against one’s own party, or attending the meetings of a rival party, can amount to it by inference. Second, if he votes, or abstains from voting, in the House contrary to any direction (whip) issued by his party, without obtaining prior permission, and the party does not condone the act within fifteen days.
Independent members. An independent legislator is disqualified the moment he joins any political party after his election. Note that he is free to support a party from outside; disqualification attaches only to formal joining.
Nominated members. A nominated member enjoys a grace period of six months from the date on which he takes his seat. Within that window he may join any political party without penalty. If he joins after six months, he is disqualified.
Exceptions
Originally the Schedule provided two exceptions — split and merger. Under the split exception, if one-third of a legislature party broke away, the defectors escaped disqualification. This clause was widely abused to engineer “wholesale” defections. The Constitution (Ninety-first Amendment) Act, 2003 deleted the split provision altogether.
Today, merger under Paragraph 4 is the only exception. A merger is deemed to have taken place only when not less than two-thirds of the members of the legislature party have agreed to the merger of the original political party with another party. Those who agree, and equally those who refuse and choose to function as a separate group, are both protected.
A second, narrower exemption protects the presiding officer. If a member is elected as Speaker or Deputy Speaker of the Lok Sabha or a Legislative Assembly, or as Chairman or Deputy Chairman of the Rajya Sabha or a Legislative Council, he may give up his party membership on assuming that office and rejoin the party after he ceases to hold it, without attracting disqualification. This safeguards the neutrality of the Chair.
Who decides, and is the decision final?
Under Paragraph 6, the question of disqualification is decided by the Chairman or the Speaker of the House concerned, and that decision is declared “final”. Where the question relates to the presiding officer himself, it is decided by a member elected by the House. Paragraph 8 empowers the presiding officer to frame rules for giving effect to the Schedule.
Paragraph 7 originally excluded the jurisdiction of all courts in respect of any matter connected with disqualification. In Kihoto Hollohan v. Zachillhu (1992), a five-judge Constitution Bench upheld the validity of the Tenth Schedule as a whole but struck down Paragraph 7 by a 3:2 majority. The Court reasoned that ousting the jurisdiction of the High Courts and the Supreme Court affected Articles 136, 226 and 227, and therefore required ratification by not less than half the State Legislatures under the proviso to Article 368(2) — a step that had not been taken. The Court further held that while adjudicating disqualification the Speaker acts as a tribunal, so the decision is amenable to judicial review, though only on limited grounds: mala fides, perversity, violation of a constitutional mandate, or denial of natural justice. Judicial intervention before the Speaker’s decision is ordinarily not permitted.
The 91st Amendment package
Besides deleting the split clause, the 2003 amendment tightened the consequences of defection. Articles 75(1B) and 164(1B) provide that a member disqualified on the ground of defection shall also be disqualified from being appointed a Minister until he is re-elected or until the expiry of his term. Article 361B extends the same bar to any remunerative political post. The same amendment inserted Article 75(1A), capping the Union Council of Ministers at 15 per cent of the strength of the Lok Sabha, and Article 164(1A), capping a State Council of Ministers at 15 per cent of the Assembly’s strength subject to a floor of twelve ministers.
Criticism
Critics argue that the law suppresses the legislator’s freedom of conscience and reduces Parliament to a body that merely registers party decisions, weakening genuine debate. The whip applies to every vote, not merely to confidence motions or money bills, which many scholars consider excessive. The absence of any time limit for the Speaker to decide a petition has allowed disqualification proceedings to be delayed for years. In Keisham Meghachandra Singh v. Speaker, Manipur (2020), the Supreme Court suggested that such petitions ordinarily be decided within three months and urged Parliament to consider transferring the power to an independent tribunal headed by a retired judge. The Election Commission and the Law Commission have separately recommended that the President or Governor decide the question on the Commission’s binding advice, as under Articles 103 and 192.

விலக்குகள்
