Qualifications [Art. 124(3)]: a citizen of India who has been a High Court judge for 5 years, or a High Court advocate for 10 years, or is a distinguished jurist in the President’s opinion.

Judges hold office until the age of 65 (High Court judges retire at 62). There is no minimum age and no fixed tenure prescribed.

Procedure: Judges (Inquiry) Act, 1968. No Supreme Court judge has ever been removed.

Article 129 makes it a Court of Record with power to punish for its own contempt. Article 130 fixes the seat at Delhi, or elsewhere as the CJI decides with the President’s approval.

Advisory jurisdiction — Art. 143: the President may refer a question of law or fact of public importance; the Court’s opinion is not binding on the President.

Article 141: law declared by the Supreme Court is binding on all courts in India. Article 142 empowers it to pass any decree needed to do complete justice. Article 137 allows review of its own judgments.

Article 145(3): a minimum of five judges must sit to decide a substantial question of constitutional interpretation or an Art. 143 reference. Article 144 requires all authorities to act in aid of the Supreme Court.

The collegium (CJI + 4 senior-most judges) emerged from the Three Judges Cases — First (1981), Second (1993) and Third (1998). The NJAC, created by the 99th Amendment Act, 2014 (Arts. 124A–124C), was struck down in the Fourth Judges Case (2015).

Judicial review and the basic structure doctrine were laid down in Kesavananda Bharati v. State of Kerala (1973), decided 7:6 by a 13-judge bench. Justice M. Fathima Beevi (1989) was the first woman judge of the Supreme Court.

📖 Detailed Notes (English)

Why the Supreme Court matters in the Indian scheme. India chose a single, integrated judicial system rather than the American double set of federal and state courts. At the apex of that single pyramid stands the Supreme Court of India, below it the High Courts, and below them the district and subordinate courts. One hierarchy administers both Union and State laws, and the Supreme Court sits at its summit as the final interpreter of the Constitution, the guardian of Fundamental Rights and the umpire of Centre–State disputes. Part V, Chapter IV of the Constitution — Articles 124 to 147 — contains the whole scheme.

Birth and growth. The Court was inaugurated on 28 January 1950, two days after the Constitution came into force. It inherited the work of the Federal Court of India, set up under the Government of India Act, 1935, and it ended the appellate role of the Privy Council in London. Its first sittings were held in the Chamber of Princes in Parliament House; it moved to its present building in 1958. Justice H. J. Kania was the first Chief Justice of India. The Court opened with just eight judges — the Chief Justice and seven others — because Article 124(1) fixes only that floor and leaves it to Parliament to raise the number by ordinary legislation. Parliament has done so repeatedly through the Supreme Court (Number of Judges) Act, 1956: the strength went to 11 in 1956, 14 in 1960, 18 in 1978, 26 in 1986, 31 in 2009 and 34 in 2019. In 2026, to tackle a pendency of well over ninety thousand cases, the puisne strength was raised from 33 to 37, taking the sanctioned total to 38 judges including the Chief Justice. Justice Surya Kant became the 53rd Chief Justice of India on 24 November 2025.

Appointment, tenure and removal. Under Article 124(2) judges are appointed by the President by warrant under his hand and seal after consultation with such judges as he considers necessary; in practice the collegium of the Chief Justice and the four next senior judges recommends names, a convention built up in the Three Judges Cases of 1981, 1993 and 1998. Parliament tried to replace that convention with a National Judicial Appointments Commission through the 99th Constitutional Amendment Act, 2014, which inserted Articles 124A, 124B and 124C. A five-judge bench struck the amendment down in 2015 in the Fourth Judges Case, holding that it damaged the independence of the judiciary, itself part of the basic structure. Article 124(3) prescribes the qualifications — Indian citizenship plus five years as a High Court judge, or ten years at a High Court bar, or the status of a distinguished jurist. A judge holds office until sixty-five, may resign by writing to the President, and can be removed only for proved misbehaviour or incapacity by the elaborate address procedure of Article 124(4) read with the Judges (Inquiry) Act, 1968. That bar is deliberately high: no Supreme Court judge has ever actually been removed. The nearest approach was the motion against Justice V. Ramaswami in 1993, which failed in the Lok Sabha for want of the required majority. Article 125 protects salaries by charging them on the Consolidated Fund of India; Article 126 provides for an acting Chief Justice; Article 127 for ad hoc judges; and Article 128 lets a retired judge be invited to sit again with his consent.

The five jurisdictions. First, original jurisdiction under Article 131 over federal disputes between the Union and one or more States, or between States — a power that is exclusive, so no other court may hear such a suit. Second, writ jurisdiction under Article 32, which itself is a Fundamental Right; the Court may issue habeas corpus, mandamus, prohibition, certiorari and quo warranto. Third, appellate jurisdiction: Article 132 for constitutional questions, Article 133 for civil matters, Article 134 for criminal appeals, Article 134A for the certificate a High Court must grant, and above all Article 136, the special leave petition, which lets the Court hear an appeal from any judgment of any court or tribunal in India at its own discretion. Fourth, advisory jurisdiction under Article 143, by which the President may refer a question of law or fact of public importance; the resulting opinion binds nobody, not even the President. Fifth, the Court is a court of record under Article 129, its proceedings are evidence in themselves and it may punish contempt.

Powers that shape governance. Article 141 makes the law declared by the Supreme Court binding on every court in India, which is how a single bench in Delhi can change administrative practice in every district. Article 142 permits any decree necessary to do complete justice, the source of many far-reaching directions. Article 137 preserves the power to review its own judgments, and Article 139A allows the transfer and consolidation of cases raising the same question. Article 145(3) requires at least five judges for a substantial question of constitutional interpretation, which is why constitution benches exist. Through judicial review the Court tests laws against the Constitution, and in Kesavananda Bharati v. State of Kerala (1973) a thirteen-judge bench held by 7:6 that Parliament’s amending power under Article 368 cannot destroy the basic structure. That doctrine was applied in Minerva Mills (1980) and again in 2015 against the NJAC. Public interest litigation, relaxed locus standi and expansive readings of Article 21 in Maneka Gandhi (1978) and K. S. Puttaswamy (2017), which recognised privacy as a Fundamental Right, together mark the Court’s journey from a purely adjudicating body to an active guarantor of rights.
