The Emergency Provisions are found in Part XVIII (Articles 352 to 360). Dr. B.R. Ambedkar described these as the feature making India’s federalism unique — the Constitution can transform into a unitary state during an emergency while remaining federal in normal times. The framework was borrowed from the Weimar Constitution of Germany. Three kinds of emergency are recognised.
National Emergency (Article 352): The most serious form. The President may proclaim it when the security of India or any part is threatened by war, external aggression, or armed rebellion. On the ground of war/external aggression it is an External Emergency; on armed rebellion it is an Internal Emergency. The 44th Amendment (1978) replaced “internal disturbance” with “armed rebellion.” The proclamation must be approved by both Houses within one month (originally two) by a special majority — a majority of the total membership of each House and two-thirds of members present and voting. Once approved it lasts six months and may be extended indefinitely with approval every six months. If one-tenth of Lok Sabha members give written notice, a special sitting is held within 14 days. Parliament may legislate on State List subjects, and the Lok Sabha term may be extended by one year at a time.
Effect on Fundamental Rights: Article 358 automatically suspends the six freedoms under Article 19, but after the 44th Amendment only when the emergency is on the ground of war or external aggression. Article 359 empowers the President to suspend, by order, the right to move courts for enforcement of specified rights. Crucially, Articles 20 and 21 can never be suspended — a safeguard added after the 1975–77 Emergency.
President’s Rule / State Emergency (Article 356): When the President, usually on the Governor’s report, is satisfied that a State cannot be governed per the Constitution, President’s Rule is imposed. The State executive is taken over by the Centre and the Assembly is suspended or dissolved. Approval is required within two months by a simple majority; it runs six months at a time up to a maximum of three years. Beyond one year, two conditions apply: a National Emergency must be in operation, and the Election Commission must certify elections cannot be held. In S.R. Bommai (1994), the Supreme Court held it subject to judicial review.
Financial Emergency (Article 360): Proclaimed if the financial stability or credit of India is threatened. Approved within two months and then continues indefinitely. The Centre may direct States on financial propriety and may reduce salaries of all Union servants, including Supreme Court and High Court Judges. It has never been declared, though India came close in the 1991 crisis.
The 44th Amendment Act (1978): Enacted after the 1975 Emergency, it replaced “internal disturbance” with “armed rebellion,” required the written recommendation of the Union Cabinet, reduced approval to one month, mandated six-monthly renewal, protected Articles 20 and 21 absolutely, and restored judicial review by deleting the immunity of the 38th Amendment.
