TNPSC Daily Notes — 28 October 2026 | Indian Polity & Constitution. Welcome to today’s bilingual study note from ATHIYAMAN ACADEMY. In this lesson we cover the Governor and the State Executive — Articles 153 to 167 of the Indian Constitution: how a Governor is appointed, the five-year term and the doctrine of pleasure, executive, legislative, financial and judicial powers, the much-debated discretionary powers under Article 163, the Governor’s four options on a Bill under Article 200, and the two landmark Supreme Court rulings of 2025 that reshaped this debate. This topic is a permanent favourite in TNPSC Group 1, 2, 2A, 4 and VAO examinations, and carries added weight for Tamil Nadu aspirants because the leading case law of 2025 arose from Tamil Nadu itself.

🏛️ The Governor & the State Executive — Articles 153 to 167

🎯 Key Points |

1

Article 153 — There shall be a Governor for each State. The 7th Constitutional Amendment Act, 1956 permits the same person to be appointed Governor for two or more States.

2

Article 154 — The executive power of the State is vested in the Governor, exercised by him directly or through officers subordinate to him, in accordance with the Constitution.

3

Article 155 — The Governor is appointed by the President by warrant under his hand and seal. He is neither directly elected nor indirectly elected by an electoral college — a key difference from the President.

4

Article 156 — A Governor holds office for a term of five years, but continues only during the pleasure of the President. He addresses his resignation to the President. There is no fixed security of tenure.

5

Article 157 — Only two qualifications are prescribed: the person must be a citizen of India and must have completed 35 years of age.

6

Article 158 — Conditions of office: he must not be a member of Parliament or a State Legislature, must hold no other office of profit, gets free use of his official residence, and his emoluments are charged on the Consolidated Fund of the State and cannot be reduced during his term.

7

Articles 159 & 160 — The oath of office is administered by the Chief Justice of the concerned High Court (in his absence, the senior-most judge available). Article 160 empowers the President to make provision for discharge of the Governor’s functions in any contingency not otherwise provided for.

8

Article 161 — Pardoning power. The Governor may grant pardons, reprieves, respites and remissions, or suspend and commute sentences, for offences against State laws. He cannot pardon a death sentence and has no power over court-martial sentences — both belong exclusively to the President under Article 72.

9

Article 162 — The executive power of the State extends to matters on which the State Legislature has power to make laws, i.e. the State List and the Concurrent List.

10

Article 163 — the discretion clause. There shall be a Council of Ministers headed by the Chief Minister to aid and advise the Governor, except in so far as he is required to exercise his functions in his discretion. Under Article 163(2) the Governor’s own decision on whether a matter falls within his discretion is final, and shall not be called in question.

11

Article 164 — The Governor appoints the Chief Minister, and the other Ministers on the Chief Minister’s advice; the Council of Ministers is collectively responsible to the Legislative Assembly. Article 164(1A), inserted by the 91st Amendment Act, 2003, caps the Council of Ministers at 15% of the total strength of the Legislative Assembly, subject to a minimum of 12.

12

Articles 165, 166 & 167 — Article 165: the Governor appoints the Advocate General of the State. Article 166: all executive action of the State is expressed in the name of the Governor, and he makes rules for the convenient transaction of business. Article 167: it is the duty of the Chief Minister to furnish information relating to administration and legislative proposals to the Governor.

13

Article 200 — four options on a Bill. When a Bill passed by the State Legislature is presented to the Governor he may (i) assent, (ii) withhold assent, (iii) return the Bill (other than a Money Bill) for reconsideration with a message, or (iv) reserve it for the consideration of the President. If the House passes it again, the Governor shall not withhold assent. Article 201 governs Bills reserved for the President; Article 213 gives the Governor ordinance-making power when the House is not in session.

14

8 April 2025 — State of Tamil Nadu v. Governor of Tamil Nadu. A two-judge Bench of Justices J.B. Pardiwala and R. Mahadevan held that Governor R.N. Ravi’s reservation of 10 re-passed Bills for the President was illegal and erroneous, prescribed timelines, and used Article 142 to declare those Bills deemed to have been assented to — the first such order in Indian constitutional history.

15

20 November 2025 — the Presidential Reference opinion (Article 143). A five-judge Constitution Bench of CJI B.R. Gavai and Justices Surya Kant, Vikram Nath, P.S. Narasimha and A.S. Chandurkar answered the President’s 14 questions: courts cannot fix timelines for the Governor or the President, there is no concept of deemed assent, Article 142 cannot substitute their constitutional powers, and Bills cannot be challenged before enactment. Only a limited mandamus is available where inaction is prolonged, unexplained and indefinite.

Reform reports & Tamil Nadu today. The Rajamannar Committee (constituted 22 September 1969 by the DMK Government of Tamil Nadu under Dr. P.V. Rajamannar, former Chief Justice of the Madras High Court; report 1971) sought deletion of Articles 356, 357 and 365. The Sarkaria Commission (1983–88) said the Governor should be an eminent person from outside the State and not an active politician. The Punchhi Commission (2007–10) urged a fixed tenure and removal only by a resolution of the State Legislature. The present Governor of Tamil Nadu is Rajendra Vishwanath Arlekar, appointed full-time on 12 October 2026.

📖 Detailed Notes — English

1. The constitutional position of the Governor

Part VI of the Constitution, beginning at Article 152, deals with the government of the States. Article 153 opens the chapter with a deceptively simple sentence: there shall be a Governor for each State. The Governor is the constitutional head of the State executive, occupying a position broadly parallel to that of the President at the Union level. He is also, by convention and by statute, the representative of the Union Government in the State — and it is precisely this dual character, head of the State and agent of the Centre, that has made the office the most contested one in Indian federalism.

The framers deliberately chose a nominated Governor over an elected one. The Constituent Assembly debated an elected Governor at length but rejected the idea, fearing that an elected Governor with his own popular mandate would create a rival centre of power against the Chief Minister and encourage separatist tendencies. Dr. B.R. Ambedkar explained that since the Governor would have no functions except those he discharges on ministerial advice and his limited discretionary ones, election would be an expensive and pointless exercise. The 7th Amendment Act of 1956 added a proviso to Article 153 allowing one person to be Governor of two or more States — the basis of the familiar additional-charge arrangements seen to this day.

2. Appointment, term and the doctrine of pleasure

Under Article 155 the Governor is appointed by the President by warrant under his hand and seal, which in practice means appointment by the Union Council of Ministers. Article 157 lays down only two qualifications — Indian citizenship and completion of 35 years of age. Two conventions have grown around the appointment: that the person should normally be from outside the State, and that the Chief Minister should be consulted. Neither is legally enforceable, and the breach of the second has been a recurring source of friction.

Article 156 is the heart of the tenure problem. The Governor holds office for five years, but the opening words of the Article say he holds office during the pleasure of the President. The five-year term is therefore a maximum, not a guarantee. In B.P. Singhal v. Union of India (2010) the Supreme Court held that while the power of removal need not be exercised for stated reasons and is not subject to the principles of natural justice, it cannot be exercised arbitrarily, capriciously or for whimsical reasons, and a removal can be judicially reviewed on that limited ground. Article 158 completes the picture of independence: no membership of a legislature, no office of profit, a rent-free residence, and emoluments charged on the Consolidated Fund of the State so that they are not votable by the Assembly.

3. The four classes of power

The Governor’s powers fall into four groups. Executive powers (Articles 154, 162, 164, 165, 166) include the appointment of the Chief Minister, Ministers, the Advocate General, the Chairman and members of the State Public Service Commission, and the issuing of all executive orders in his name. Legislative powers include summoning, proroguing and dissolving the Assembly, addressing and sending messages to the House, nominating one-sixth of the members of a Legislative Council from the fields of literature, science, art, cooperative movement and social service, assenting to Bills under Article 200, and promulgating ordinances under Article 213. Financial powers include causing the annual budget to be laid before the Legislature, the requirement of his recommendation for a Money Bill and for any demand for a grant, and control of the Contingency Fund of the State. Judicial powers consist of the pardoning power under Article 161 and consultation by the President in the appointment of High Court judges.

4. Discretionary powers — Article 163

Article 163(1) requires a Council of Ministers headed by the Chief Minister to aid and advise the Governor, except in so far as he is required to act in his discretion. Article 163(2) then makes his own view on what falls within that discretion final and immune from question. The Constitution expressly confers discretion in a few places — reserving a Bill for the President under Article 200, recommending President’s Rule under Article 356, exercising functions as administrator of an adjoining Union Territory, and the special responsibilities for Maharashtra, Gujarat, Nagaland, Assam, Manipur, Sikkim, Arunachal Pradesh and Goa. Beyond these there are situational discretions: appointing a Chief Minister when no party has a clear majority, dismissing a Ministry that has lost confidence, and dissolving an Assembly where no alternative government is possible. In Shamsher Singh v. State of Punjab (1974) the Court stressed that the Governor is a constitutional head bound by ministerial advice outside these narrow areas; in S.R. Bommai v. Union of India (1994) it insisted that majority be tested on the floor of the House, not in the Raj Bhavan; and in Nabam Rebia (2016) it held that the Governor cannot summon or dissolve the House at his own will against ministerial advice.

5. Assent to Bills and the two rulings of 2025

Article 200 gives the Governor four options on a Bill, but famously prescribes no time limit — the phrase used is merely “as soon as possible”. That silence produced the Tamil Nadu dispute. On 8 April 2025, in State of Tamil Nadu v. Governor of Tamil Nadu, Justices J.B. Pardiwala and R. Mahadevan held that Governor R.N. Ravi had acted illegally in reserving ten re-passed Bills for the President, laid down indicative timelines of one month and three months, and invoked Article 142 to declare the ten Bills deemed to have been assented to. The Union then made a Presidential Reference under Article 143 in May 2025, posing fourteen questions. On 20 November 2025 a Constitution Bench headed by CJI B.R. Gavai answered that courts cannot impose timelines on the Governor or the President, that “deemed assent” is impermissible because it would amount to a judicial takeover of executive functions, that Article 142 cannot substitute their constitutional powers, and that a Bill cannot be challenged before it becomes law — while preserving a limited mandamus to compel a decision where inaction is prolonged, unexplained and indefinite. For the exam, remember both rulings and the direction of travel between them.

6. Reform proposals

Tamil Nadu has its own place in this story. The Rajamannar Committee, constituted on 22 September 1969 under Dr. P.V. Rajamannar and reporting in 1971, was the first systematic State-level demand for autonomy and sought the deletion of Articles 356, 357 and 365 along with curbs on the Governor’s discretion. The Sarkaria Commission (1983–88) recommended that the Governor be an eminent person from outside the State, detached from local politics, appointed after consultation with the Chief Minister, and not removed before five years except for compelling reasons. The Punchhi Commission (2007–10) went further, proposing a selection committee, a fixed tenure, removal only by a resolution of the State Legislature, the end of the doctrine of pleasure, and the withdrawal of the Governor’s statutory role as university Chancellor.

💡 Memory Tips |
