📖 Detailed Notes (English)

The long road to constitutional status. Local self-government is not a new idea in India — the Chola inscriptions at Uttiramerur record village assemblies choosing their own committees a thousand years ago. But when the Constitution came into force in 1950, panchayats found a place only in Article 40, a Directive Principle asking the State to organise village panchayats and endow them with such powers as may be necessary to function as units of self-government. Being a Directive Principle, it was not enforceable in a court, and progress depended entirely on the will of individual State governments. The Community Development Programme (1952) and the National Extension Service (1953) both faltered for want of popular participation, and the Balwant Rai Mehta Committee appointed in 1957 traced the failure to the absence of an elected local agency. It recommended a three-tier structure — Gram Panchayat at the village, Panchayat Samiti at the block and Zila Parishad at the district — and called the scheme “democratic decentralisation”. Rajasthan was the first State to act, Jawaharlal Nehru inaugurating the system at Nagaur on 2 October 1959; Andhra Pradesh followed within weeks.

Committees that shaped the law. The initial enthusiasm faded through the 1960s as elections were postponed and funds dried up. The Ashok Mehta Committee (1977) proposed a two-tier system with the Zila Parishad as the pivot and a Mandal Panchayat below it, and argued that panchayats should be openly political rather than pretend to be non-party bodies. The G. V. K. Rao Committee (1985) famously described the district administration as having become “grass without roots”, and the L. M. Singhvi Committee (1986) made the decisive recommendation — that panchayats should be given constitutional recognition and that the Gram Sabha should be treated as the base of a decentralised democracy. A first attempt to give effect to this, the 64th Constitutional Amendment Bill of 1989 introduced during Rajiv Gandhi’s tenure, was passed by the Lok Sabha but defeated in the Rajya Sabha. The idea returned in 1991 and became the 73rd Constitutional Amendment Act, 1992, which came into force on 24 April 1993 — now National Panchayati Raj Day. Its urban twin, the 74th Amendment, added Part IXA and the Twelfth Schedule with 18 subjects for municipalities.

Structure and elections. Part IX runs from Article 243 to Article 243-O. Article 243A gives constitutional recognition to the Gram Sabha, the assembly of all registered voters of a village, and leaves it to the State legislature to decide what powers it exercises. Article 243B makes a three-tier structure compulsory, with one relaxation: a State whose population does not exceed twenty lakh need not constitute the intermediate tier. Article 243C requires that all seats at every level be filled by direct election from territorial constituencies; the chairperson of a village panchayat is elected in the manner the State law provides, while chairpersons at the intermediate and district levels are elected by and from among the elected members. Article 243D reserves seats for Scheduled Castes and Scheduled Tribes in proportion to their share of the population, and reserves not less than one-third of all seats, and one-third of the offices of chairperson, for women — including within the SC and ST quota. Many States, Tamil Nadu among them, have since raised the women’s quota to fifty per cent.

Term, finance and supervision. Article 243E guarantees a five-year term and, crucially, requires that elections be completed before the expiry of that term; if a panchayat is dissolved early, elections must be held within six months and the newly constituted body serves only the unexpired remainder. This single provision ended the era in which State governments could keep panchayats in suspended animation indefinitely. Article 243F fixes twenty-one as the minimum age for candidature. Article 243G empowers State legislatures to devolve powers over the twenty-nine subjects listed in the Eleventh Schedule — agriculture, minor irrigation, animal husbandry, rural housing, drinking water, poverty alleviation, primary education, health and sanitation, public distribution and social welfare among them. Article 243H allows panchayats to be authorised to levy taxes and duties, and Article 243I obliges the Governor to constitute a State Finance Commission every five years to review their financial position. Article 243K vests the superintendence, direction and control of panchayat elections in a State Election Commission whose commissioner is appointed by the Governor. Article 243-O bars courts from interfering in the delimitation of constituencies or in an election except by an election petition.

Exceptions and the Tamil Nadu position. Article 243M keeps Part IX out of Nagaland, Meghalaya and Mizoram, the hill areas of Manipur where a district council exists, and the Scheduled and tribal areas — a gap partly closed by the Provisions of the Panchayats (Extension to the Scheduled Areas) Act, 1996, known as PESA, which extended Part IX to Scheduled Areas with special safeguards for tribal customs and the Gram Sabha. Tamil Nadu gave effect to the amendment through the Tamil Nadu Panchayats Act, 1994, in force from 22 April 1994, which established the Village Panchayat, the Panchayat Union Council at the block level and the District Panchayat. Village panchayat presidents in Tamil Nadu are directly elected by the voters of the panchayat, and the State amended its municipal and panchayat laws in 2016 to raise the reservation for women to fifty per cent. For TNPSC purposes, remember the pairing that examiners love: 73rd Amendment — Part IX — Eleventh Schedule — 29 subjects — rural, against 74th Amendment — Part IXA — Twelfth Schedule — 18 subjects — urban.

💡 Memory Tips / நினைவூட்டல் உத்திகள்

1. “73 – 9 – 11 – 29” and “74 – 9A – 12 – 18”. Read them as two ladders: rural first, urban second. The amendment number, the Part, the Schedule and the number of subjects march in the same order every time.
