Article 52 declares that there shall be a President of India. He or she is the constitutional Head of the State, the First Citizen of India and the symbol of the unity of the nation.

Article 54 — the President is elected by an Electoral College consisting of the ELECTED members of both Houses of Parliament and the ELECTED members of the Legislative Assemblies of the States, plus Delhi, Puducherry and Jammu & Kashmir. Nominated MPs and all MLCs have no vote.

Article 55 insists on uniformity in the scale of representation among States and parity between the States as a whole and the Union. Vote values are still computed on the 1971 Census, frozen by the 84th Amendment Act, 2001 until the figures of the first census after 2026 are published.

The election is held by the system of proportional representation by means of the single transferable vote, and the voting is by secret ballot. A candidate must secure more than 50 per cent of the valid votes polled — the electoral quota.

Article 58 — qualifications: a citizen of India, who has completed 35 years of age, is qualified for election as a member of the Lok Sabha, and does not hold any office of profit. A sitting Vice-President, Governor or Minister is not disqualified.

Article 60 — the oath of office is administered by the Chief Justice of India, and in his absence by the senior-most judge of the Supreme Court available. The President swears to preserve, protect and defend the Constitution and the law.

Article 61 — impeachment lies only for VIOLATION OF THE CONSTITUTION. The charge may be preferred by either House after 14 days’ notice signed by at least one-fourth of its members, and must be passed by a majority of not less than two-thirds of the TOTAL MEMBERSHIP of that House; the other House then investigates. Nominated members, who cannot vote in the election, DO take part in impeachment.

Article 72 — the President may grant pardons, reprieves, respites and remissions of punishment, or suspend, remit and commute sentences, in court-martial cases, in offences against Union law, and in ALL death-sentence cases. This power is wider than a Governor’s under Article 161.

Veto powers: the President enjoys an ABSOLUTE veto (withholding assent), a SUSPENSIVE veto (returning a non-money Bill for reconsideration — he must assent if it is passed again) and a POCKET veto (taking no action, as Article 111 prescribes no time limit). Giani Zail Singh’s handling of the Indian Post Office (Amendment) Bill, 1986 is the classic pocket-veto example. He has NO veto over a Constitutional Amendment Bill — the 24th Amendment, 1971 made assent compulsory.

Article 123 — the President may promulgate an Ordinance when either House is not in session. It must be laid before Parliament and ceases to operate six weeks after reassembly. In D. C. Wadhwa v. State of Bihar (1987) the Supreme Court held that repeated re-promulgation of ordinances is a fraud on the Constitution.

Article 74 makes the aid and advice of the Council of Ministers BINDING on the President — the 42nd Amendment, 1976 made it binding and the 44th Amendment, 1978 allowed him to return it once for reconsideration, after which he must act on it. Article 78 entitles him to be furnished information on Union affairs by the Prime Minister.

All doubts and disputes arising out of a presidential election are inquired into and decided by the Supreme Court alone (Article 71), and its decision is final. Smt. Droupadi Murmu, declared elected on 21 July 2022 and sworn in on 25 July 2022, is the 15th President and the first from a tribal community.

1. The office and its constitutional place
The framers of the Constitution chose a parliamentary system with a nominal executive. Article 52 creates the office in the barest possible words, and Article 53 then pours the entire executive power of the Union into it. The result is a Head of State in whose name every executive action of the Government of India is taken (Article 77), who appoints the Prime Minister, the Council of Ministers, the Attorney-General, the Comptroller and Auditor-General, the Chief Election Commissioner, the judges of the Supreme Court and the High Courts, the Governors of States, the Chairmen of the UPSC and the Finance Commission — and who, in the ordinary course, exercises almost none of this discretion personally. Dr. B. R. Ambedkar captured it precisely in the Constituent Assembly: the President occupies the same position as the King under the English Constitution, he is the head of the State but not of the Executive, he represents the nation but does not rule it.
2. Why an indirect election?
A directly elected President would have been able to claim a popular mandate rivalling that of the Prime Minister, and in a parliamentary system that is a recipe for deadlock. So Article 54 created an Electoral College of elected legislators only, and Article 55 built two kinds of balance into it. The first is uniformity among the States: a vote cast by an MLA of a populous State must carry proportionately greater weight than one cast by an MLA of a small State. The second is parity between the Union and the States taken together: the 776 elected Members of Parliament together must carry (as nearly as possible) the same total value as all the MLAs of the country put together. This is why the value of an MP’s vote is not fixed independently but is derived by dividing the aggregate MLA value by 776.
The arithmetic is worth memorising because TNPSC asks it directly. An MLA’s vote value is the 1971 population of the State divided by the number of its elected MLAs, divided again by 1,000, with fractions of a half and above rounded up. In 2022 that gave Uttar Pradesh 208 per MLA, Maharashtra 175, Tamil Nadu 176, Kerala 152, and Sikkim just 7. The total MLA value was 5,43,231 from 4,033 MLAs, so each MP’s vote was worth 5,43,231 divided by 776, which is 700 after rounding — down from 708 in 2017, because the Jammu and Kashmir Legislative Assembly stood dissolved and its 83 MLAs were not in the college. The total value of the 2022 Electoral College was therefore 10,86,431, and the winning quota was half of the valid votes polled plus one. Smt. Droupadi Murmu secured about 64 per cent of the valued votes polled.
3. Term, vacancy and oath
Article 56 gives a five-year term running from the date the President enters upon office; he holds office until his successor enters upon office even if the term has run out, so there is never a gap. He may resign in writing to the Vice-President, who must communicate it to the Speaker of the Lok Sabha. Article 62 requires an election to fill a vacancy caused by expiry of term to be completed before the term expires, and a vacancy caused by death, resignation or removal to be filled within six months. The Vice-President acts as President in such a vacancy, and if both offices are vacant the Chief Justice of India acts — M. Hidayatullah did so in 1969. Article 57 allows unlimited re-election, and Article 60 entrusts the oath to the Chief Justice of India.
4. Removal: a quasi-judicial process
Impeachment under Article 61 is the only mode of removal, and the only ground is violation of the Constitution — a phrase the Constitution deliberately leaves undefined. The process is quasi-judicial: a resolution must be moved in either House after fourteen days’ written notice signed by not less than one-fourth of the total members of that House, and carried by a majority of not less than two-thirds of the total membership of that House. The other House then investigates the charge; the President has the right to appear and be represented. If the second House also passes the resolution by the same special majority, the President stands removed from the date of that resolution. Two points are heavily examined: nominated members of both Houses, who have no vote in electing the President, do participate in his impeachment; and State Legislative Assemblies, who help elect him, have no role in removing him. No Indian President has ever been impeached.
5. The powers in five buckets
Executive — appointments and removals, administration of Union Territories, the right under Article 78 to be informed. Legislative — summoning, proroguing and dissolving Parliament, addressing the opening session, nominating 12 members to the Rajya Sabha and 2 Anglo-Indians to the Lok Sabha (the latter lapsed in January 2020 on the expiry of Article 334 as amended by the 104th Amendment), prior recommendation for Money Bills and for Bills altering State boundaries, assent under Article 111. Financial — the Annual Financial Statement is laid before Parliament on his recommendation, no demand for a grant can be made without it, and he operates the Contingency Fund of India. Judicial — appointment of judges, the pardoning power under Article 72, and the power under Article 143 to seek the Supreme Court’s advisory opinion. Emergency — Articles 352, 356 and 360.
6. The three vetoes
Article 111 lets the President assent to a Bill, withhold assent, or return a Bill other than a Money Bill with a message for reconsideration. Textbooks call these the absolute, suspensive and pocket vetoes. The absolute veto is real but is used only for private members’ Bills or where the Cabinet that advised the Bill has fallen. The suspensive veto is weak, because if Parliament passes the Bill again, with or without amendment, assent cannot be withheld. The pocket veto exists only because Article 111 sets no time limit on the President — the one famous exercise being President Giani Zail Singh’s decision simply not to act on the Indian Post Office (Amendment) Bill, 1986. Over a State Bill reserved under Article 201 the President’s veto is in fact absolute, and over a Constitutional Amendment Bill he has no veto at all, assent having been made obligatory by the 24th Amendment Act, 1971.
For TNPSC, the thread running through all of this is Article 74: the President acts on the binding aid and advice of the Council of Ministers, may return that advice once for reconsideration under the 44th Amendment, and must then accept it. Real discretion survives only in the narrow spaces the text leaves open — choosing a Prime Minister when no party has a majority, dismissing a Ministry that has lost confidence and will not resign, and dissolving the Lok Sabha when the advising Ministry no longer commands the House.

2. மறைமுகத் தேர்தல் எதற்காக?
நேரடியாகத் தேர்ந்தெடுக்கப்படும் குடியரசுத் தலைவர், பிரதமருக்கு இணையான மக்கள் ஆணையைக் கோர முடியும்; நாடாளுமன்ற முறையில் அது முட்டுக்கட்டைக்கே வழிவகுக்கும். எனவே பிரிவு 54, தேர்ந்தெடுக்கப்பட்ட சட்டமன்ற உறுப்பினர்களை மட்டுமே கொண்ட தேர்தல் குழுவை உருவாக்கியது; பிரிவு 55 அதில் இரண்டு வகையான சமநிலையை அமைத்தது. முதலாவது மாநிலங்களுக்கு இடையேயான ஒருமைப்பாடு: அதிக மக்கள்தொகை கொண்ட மாநிலத்தின் சட்டமன்ற உறுப்பினர் அளிக்கும் வாக்கு, சிறிய மாநிலத்தின் உறுப்பினர் வாக்கை விட விகிதாசாரப்படி அதிக மதிப்புடையதாக இருக்க வேண்டும். இரண்டாவது, ஒன்றியத்திற்கும் மாநிலங்கள் அனைத்திற்கும் இடையேயான சமநிலை: தேர்ந்தெடுக்கப்பட்ட 776 நாடாளுமன்ற உறுப்பினர்களின் மொத்த மதிப்பு, நாட்டின் அனைத்து சட்டமன்ற உறுப்பினர்களின் மொத்த மதிப்புக்கு இயன்றவரை சமமாக இருக்க வேண்டும். இதனால்தான் ஒரு எம்.பி.யின் வாக்கு மதிப்பு தனியாக நிர்ணயிக்கப்படுவதில்லை; சட்டமன்ற உறுப்பினர்களின் மொத்த மதிப்பை 776-ஆல் வகுத்தே பெறப்படுகிறது.
இந்தக் கணக்கை மனப்பாடம் செய்வது அவசியம், ஏனெனில் TNPSC இதை நேரடியாகக் கேட்கிறது. ஒரு சட்டமன்ற உறுப்பினரின் வாக்கு மதிப்பு = அந்த மாநிலத்தின் 1971 மக்கள்தொகையை அதன் தேர்ந்தெடுக்கப்பட்ட உறுப்பினர்கள் எண்ணிக்கையால் வகுத்து, மீண்டும் 1,000-ஆல் வகுத்துக் கிடைப்பது; அரைக்கும் மேலான பின்னங்கள் மேல்நோக்கி முழுமையாக்கப்படும். 2022-இல் இது உத்தரப் பிரதேசத்திற்கு 208, மகாராஷ்டிராவுக்கு 175, தமிழ்நாட்டுக்கு 176, கேரளாவுக்கு 152, சிக்கிமுக்கு வெறும் 7 என வந்தது. 4,033 சட்டமன்ற உறுப்பினர்களின் மொத்த மதிப்பு 5,43,231; எனவே ஒரு எம்.பி.யின் வாக்கு 5,43,231 ÷ 776 = 700 (முழுமையாக்கிய பின்). 2017-இல் இது 708 ஆக இருந்தது; ஜம்மு–காஷ்மீர் சட்டமன்றம் கலைக்கப்பட்டிருந்ததால் அதன் 83 உறுப்பினர்கள் தேர்தல் குழுவில் இடம்பெறாமல் போனதே இந்தக் குறைவுக்குக் காரணம். எனவே 2022 தேர்தல் குழுவின் மொத்த மதிப்பு 10,86,431; வெற்றிக்குத் தேவையான அளவு, செல்லத்தக்க வாக்குகளின் பாதி மற்றும் ஒன்று. திருமதி திரௌபதி முர்மு, பதிவான மதிப்பு வாக்குகளில் சுமார் 64 சதவீதத்தைப் பெற்றார்.
3. பதவிக் காலம், காலியிடம், பிரமாணம்
பிரிவு 56, பதவியேற்ற நாளிலிருந்து ஐந்து ஆண்டுப் பதவிக் காலத்தை வழங்குகிறது; பதவிக் காலம் முடிந்தாலும் தனது வாரிசு பதவியேற்கும் வரை அவர் பதவியில் தொடர்வார் — எனவே இடைவெளி ஏற்படுவதில்லை. குடியரசுத் துணைத் தலைவருக்கு எழுத்து மூலம் தெரிவித்து அவர் பதவி விலகலாம்; அதை துணைத் தலைவர் மக்களவைத் தலைவருக்குத் தெரிவிக்க வேண்டும். பிரிவு 62-இன் படி, பதவிக் காலம் முடிவதால் ஏற்படும் காலியிடத்திற்கான தேர்தல் அந்தக் காலம் முடிவதற்கு முன்பே நிறைவு பெற வேண்டும்; இறப்பு, பதவி விலகல் அல்லது பதவி நீக்கத்தால் ஏற்படும் காலியிடம் ஆறு மாதங்களுக்குள் நிரப்பப்பட வேண்டும். அத்தகைய காலியிடத்தில் குடியரசுத் துணைத் தலைவர் பதில் தலைவராகச் செயல்படுவார்; இரு பதவிகளும் காலியாக இருந்தால் இந்தியத் தலைமை நீதிபதி செயல்படுவார் — 1969-இல் எம். ஹிதயத்துல்லா இவ்வாறு செயல்பட்டார். பிரிவு 57 வரம்பில்லாத மறு தேர்வுக்கு அனுமதிக்கிறது; பிரிவு 60 பிரமாணத்தை ஏற்கும் பொறுப்பை தலைமை நீதிபதியிடம் ஒப்படைக்கிறது.
4. பதவி நீக்கம் — ஒரு அரை நீதித்துறை நடைமுறை
பிரிவு 61-இன் கீழ் பதவி நீக்கம் மட்டுமே அவரை நீக்கும் ஒரே வழி; அதற்கான ஒரே காரணம் அரசியலமைப்பை மீறுதல் — இந்தச் சொல்லை அரசியலமைப்பு வேண்டுமென்றே வரையறுக்கவில்லை. நடைமுறை அரை நீதித்துறை சார்ந்தது: அந்த அவையின் மொத்த உறுப்பினர்களில் கால் பகுதிக்குக் குறையாதவர்கள் கையொப்பமிட்ட பதினான்கு நாள் எழுத்து அறிவிப்புக்குப் பிறகு ஏதேனும் ஒரு அவையில் தீர்மானம் கொண்டுவரப்பட வேண்டும்; அந்த அவையின் மொத்த உறுப்பினர் எண்ணிக்கையில் மூன்றில் இரண்டு பங்குக்குக் குறையாத பெரும்பான்மையால் அது நிறைவேற்றப்பட வேண்டும். பின்னர் மற்றொரு அவை குற்றச்சாட்டை விசாரிக்கும்; குடியரசுத் தலைவருக்கு ஆஜராகவும் தனக்காக வாதிட வைக்கவும் உரிமை உண்டு. இரண்டாவது அவையும் அதே சிறப்புப் பெரும்பான்மையில் தீர்மானத்தை நிறைவேற்றினால், அந்தத் தீர்மானத்தின் நாளிலிருந்து அவர் பதவி நீக்கம் செய்யப்படுகிறார். இரண்டு கூறுகள் அடிக்கடி கேட்கப்படுகின்றன: தேர்தலில் வாக்குரிமை இல்லாத நியமன உறுப்பினர்கள் பதவி நீக்கத்தில் பங்கேற்கிறார்கள்; அவரைத் தேர்ந்தெடுக்க உதவிய மாநில சட்டமன்றங்களுக்கு அவரை நீக்குவதில் எந்தப் பங்கும் இல்லை. இந்திய வரலாற்றில் எந்தக் குடியரசுத் தலைவரும் பதவி நீக்கம் செய்யப்பட்டதில்லை.
5. அதிகாரங்கள் — ஐந்து பிரிவுகள்
நிர்வாக அதிகாரங்கள் — நியமனங்கள், நீக்கங்கள், ஒன்றியப் பிரதேச நிர்வாகம், பிரிவு 78-இன் கீழ் தகவல் பெறும் உரிமை. சட்டமியற்றும் அதிகாரங்கள் — நாடாளுமன்றத்தைக் கூட்டுதல், ஒத்திவைத்தல், மக்களவையைக் கலைத்தல், தொடக்கக் கூட்டத்தில் உரையாற்றுதல், மாநிலங்களவைக்கு 12 உறுப்பினர்களை நியமித்தல் (ஆங்கிலோ–இந்தியர் இரு இடங்கள் 104-வது திருத்தத்தால் 2020 ஜனவரியில் முடிவுக்கு வந்தது), பண மசோதாக்களுக்கும் மாநில எல்லை மாற்ற மசோதாக்களுக்கும் முன் ஒப்புதல், பிரிவு 111-இன் கீழ் ஒப்புதல். நிதி அதிகாரங்கள் — ஆண்டு நிதிநிலை அறிக்கை அவரது பரிந்துரையின் பேரிலேயே நாடாளுமன்றத்தில் வைக்கப்படுகிறது; அவரது பரிந்துரையின்றி மானியக் கோரிக்கை வைக்க முடியாது; இந்திய தற்செயல் நிதியை அவரே இயக்குகிறார். நீதித்துறை அதிகாரங்கள் — நீதிபதிகள் நியமனம், பிரிவு 72-இன் கீழ் மன்னிப்பு அதிகாரம், பிரிவு 143-இன் கீழ் உச்ச நீதிமன்றத்தின் ஆலோசனையைக் கோரும் அதிகாரம். நெருக்கடி நிலை அதிகாரங்கள் — பிரிவுகள் 352, 356, 360.
6. மூன்று வீட்டோக்கள்
பிரிவு 111, ஒரு மசோதாவுக்கு ஒப்புதல் அளிக்கவும், ஒப்புதலை நிறுத்திவைக்கவும், பண மசோதா அல்லாத ஒரு மசோதாவை செய்தியுடன் மறுபரிசீலனைக்குத் திரும்ப அனுப்பவும் குடியரசுத் தலைவரை அனுமதிக்கிறது. இவற்றையே பாடப் புத்தகங்கள் முழுமையான, இடைநிறுத்த, பாக்கெட் வீட்டோ என்கின்றன. முழுமையான வீட்டோ உண்மையில் உள்ளது; ஆனால் தனி உறுப்பினர் மசோதாக்களுக்கு அல்லது மசோதாவுக்கு ஆலோசனை வழங்கிய அமைச்சரவை கவிழ்ந்த நிலையில் மட்டுமே பயன்படுத்தப்படுகிறது. இடைநிறுத்த வீட்டோ பலவீனமானது; நாடாளுமன்றம் அதே மசோதாவை திருத்தத்துடனோ இல்லாமலோ மீண்டும் நிறைவேற்றினால் ஒப்புதலை நிறுத்த முடியாது. பிரிவு 111 குடியரசுத் தலைவருக்கு எந்தக் கால வரம்பையும் நிர்ணயிக்காததால் மட்டுமே பாக்கெட் வீட்டோ சாத்தியமாகிறது — 1986-ஆம் ஆண்டின் இந்திய தபால் அலுவலகத் திருத்த மசோதாவின் மீது எந்த நடவடிக்கையும் எடுக்காமல் இருக்க குடியரசுத் தலைவர் ஞானி ஜெயில் சிங் முடிவெடுத்ததே புகழ்பெற்ற ஒரே உதாரணம். பிரிவு 201-இன் கீழ் ஒதுக்கி வைக்கப்படும் மாநில மசோதாவின் மீது அவரது வீட்டோ உண்மையில் முழுமையானது; அரசியலமைப்புத் திருத்த மசோதாவின் மீது வீட்டோ எதுவும் இல்லை, ஏனெனில் 1971-ஆம் ஆண்டின் 24-வது திருத்தச் சட்டம் ஒப்புதலைக் கட்டாயமாக்கிவிட்டது.
